Recently, the Tennessee House of Representatives unanimously passed a bill that extends the deadline for an injured employee to file a claim for increased benefits. What is the Bill?
Senator Jack Johnson introduced the bill, S.B. 2190, modifying the timeline for an injured employee to request an increase in benefits from the Tennessee Bureau of Workers Compensation. The deadline was moved from 60 days to 180 days after an employee reaches maximum medical improvement. In addition to this, the bill increases the period of time after an injury that the employee must notify the Workers Compensation Bureau of their injury and the failure of the employer to secure payment from 60 to 180 days. It also deleted the requirement that a final hearing must be held within 60 days of the request for benefits form the Uninsured Employers Fund.
This bill was passed unanimously in the state’s Senate in early March and would take effect immediately if it were to be signed into law.
